1. Acceptance of Terms

By accessing and using the services of PLAIGROUND ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our website and web design services.

2. Description of Services

PLAIGROUND provides the following services:

  • Web design and development
  • E-commerce website development
  • Mobile application development
  • UI/UX design services
  • Website maintenance and support
  • Digital marketing services
  • Search engine optimization (SEO)
  • Website hosting and domain services

3. Client Responsibilities

3.1 Project Information

Clients are responsible for providing:

  • Accurate and complete project requirements
  • All necessary content, images, and materials
  • Timely feedback and approvals
  • Access to necessary accounts and systems
  • Payment as agreed in the project contract

3.2 Content Ownership

Clients must ensure they have the legal right to use all content, images, and materials provided for their project. PLAIGROUND is not responsible for copyright infringement or other legal issues arising from client-provided content.

4. Project Terms

4.1 Project Scope

All projects are defined by a written contract or proposal that outlines the scope of work, timeline, deliverables, and pricing. Any changes to the project scope must be agreed upon in writing by both parties.

4.2 Timeline

Project timelines are estimates based on the information provided by the client. Delays caused by late feedback, missing content, or scope changes may affect the delivery timeline.

4.3 Revisions

Each project includes a specified number of revision rounds as outlined in the project contract. Additional revisions may incur additional charges.

5. Payment Terms

5.1 Payment Schedule

Payment terms are as follows:

  • 50% deposit required to begin work
  • 25% payment due at project milestone (as defined in contract)
  • 25% final payment due upon project completion

5.2 Late Payments

Late payments may result in project delays or suspension. A late fee of 1.5% per month may be applied to overdue accounts.

5.3 Refunds

Refunds are considered on a case-by-case basis. No refunds will be provided for completed work or after project delivery.

6. Intellectual Property

6.1 Client Ownership

Upon full payment, clients own the final deliverables including the website design, code, and content created specifically for their project.

6.2 PLAIGROUND Rights

PLAIGROUND retains the right to use project work for portfolio purposes and marketing materials, unless otherwise specified in the project contract.

6.3 Third-Party Components

Projects may include third-party components, plugins, or libraries. These remain subject to their respective licenses and terms.

7. Website Maintenance and Support

7.1 Maintenance Services

Website maintenance and support services are provided as outlined in the maintenance agreement. These services may include:

  • Regular security updates
  • Content updates (as specified)
  • Technical support
  • Backup services
  • Performance monitoring

7.2 Support Response Time

Support requests are typically responded to within 24-48 hours during business days (Monday-Friday, 9 AM - 6 PM SAST).

8. Hosting and Domain Services

8.1 Hosting

If hosting services are provided, they are subject to the hosting provider's terms of service. PLAIGROUND is not responsible for hosting provider downtime or issues.

8.2 Domain Registration

Domain registration and renewal services are provided through third-party registrars. Clients are responsible for domain renewal fees and maintaining domain ownership.

9. Limitation of Liability

PLAIGROUND's liability is limited to the total amount paid by the client for the specific project. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits or business opportunities
  • Third-party actions or content
  • Technical issues beyond our control
  • Client's use of the delivered work

10. Confidentiality

PLAIGROUND agrees to maintain the confidentiality of all client information and project details. We will not disclose confidential information to third parties without written consent, except as required by law.

11. Termination

11.1 Client Termination

Clients may terminate a project with 30 days written notice. Payment is due for all work completed up to the termination date.

11.2 PLAIGROUND Termination

We may terminate a project if the client breaches these terms, fails to make payments, or provides false information.

12. Force Majeure

Neither party shall be liable for delays or failures in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government actions.

13. Governing Law

These terms are governed by the laws of South Africa. Any disputes shall be resolved through arbitration in Durban, South Africa.

14. Changes to Terms

PLAIGROUND reserves the right to modify these terms at any time. Clients will be notified of significant changes. Continued use of our services constitutes acceptance of the modified terms.

15. Important Notice

By engaging PLAIGROUND's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
